Scottish Esports – Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Scottish Esports website at https://scotesports.org (the “Website”), including any membership services, community platforms, and events we provide (collectively, the “Services”). Scottish Esports is the trading name of ScotEsports CIC.
By accessing the Website, creating an account, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Website or Services.
1. Eligibility and Account Registration
To access most features of our Services, including membership, you must register for an account.
Eligibility: You must be at least 13 years old to create an account. If you are between the ages of 13 and 18, you confirm that you have obtained permission from your parent or legal guardian to create an account and use our Services.
Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
National Team Eligibility: Eligibility for selection to represent Scottish Esports as a player in national or international competitions requires you to have an active Community membership in good standing (not suspended or banned). Additional selection criteria and policies may also apply.
Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account. You must notify Scottish Esports immediately upon becoming aware of any breach of security or unauthorised use of your account.
2. Membership, Fees, and Cancellation
Automatic Renewal: Your Community membership is linked to your Scottish Esports account you create. This means that your Community membership will be active until you decide to permanently delete your account.
Cancellation: If you decide to terminate you Community Membership and can be done by permanently deleting your account.
3. Events and Tickets
- The Website may list both Scottish Esports-organised events and third-party events. This section applies only to events organised by Scottish Esports. Third-party events are covered separately under Section 8 (Third-Party Event Submissions)
- The Website hosts a national events calendar where Scottish Esports lists and sells tickets only for events organised by Scottish Esports. All tickets bought through the platform are for Scottish Esports events only.
When you purchase a ticket you enter a contract with Scottish Esports for attendance at the event. You agree to provide accurate booking and contact information, and to comply with any event-specific terms notified at booking.
Entry, ID, and refusal of admission — Entry to events may require presentation of ID or a membership/ticket. Scottish Esports and venue staff reserve the right to refuse admission or eject persons who do not comply with venue rules or who breach the Code of Conduct.
Ticket transfers & resale — Tickets are transferable only with Scottish Esports’ prior consent and must not be resold at a premium or through unauthorised resale channels. Scottish Esports may cancel tickets that have been fraudulently obtained or listed for unauthorised resale.
Cancellations and refunds — All ticket purchases are final. Refunds will not be issued for non-attendance. If Scottish Esports cancels an event you will be entitled to a full refund of the ticket price. If an event is postponed, your ticket will be valid for the rescheduled date, or you may request a full refund if you cannot attend the new date. Please note that the statutory 14-day cooling-off period for online purchases does not apply to tickets for events with a specific date. We are not responsible for cancellations or changes caused by events outside our reasonable control (force majeure), such as extreme weather, venue closure, or public health restrictions.
Third-party ticketing and payment providers — Payments and checkout are processed by third-party providers (as set out in our Privacy Policy). Your purchase is also subject to any applicable terms of those providers.
Photography and recording — Events may be photographed, filmed or recorded. By obtaining a ticket you consent to being recorded and to those images/recordings being used for promotional and archival purposes unless you have notified Scottish Esports in advance or opted out at the event.
Liability — Attendance at events is at your own risk. Where permitted by law Scottish Esports’ liability for loss or damage arising from cancelled or rescheduled events will be limited to the ticket purchase price.
4. Careers Dashboard and Applications
The Careers Dashboard publishes volunteer and employment opportunities for Scottish Esports positions only. We are not responsible for roles posted by other organisations via other channels.
Applying for any role does not guarantee employment. You are responsible for the accuracy of any application information you provide.
By applying you consent to Scottish Esports processing your application and any recruitment checks reasonably required for the position (including DBS/Disclosure checks where applicable). Any offer of employment or volunteering may be conditional on satisfactory checks.
Scottish Esports may remove or modify job postings at any time. We are not liable for any loss you suffer as a result of removed listings or withdrawn vacancies.
5. Code of Conduct
Our community is built on respect and fair play. By using our Services, you agree not to:
Engage in or promote harassment, bullying, hate speech, threats, or any form of discriminatory or abusive behaviour.
Post, share, or transmit any content that is unlawful, defamatory, obscene, fraudulent, or infringing on the rights of others.
Use our Services for any form of cheating, match-fixing, or unsportsmanlike conduct in any competition.
Disrupt or interfere with the security or functionality of the Website, our Discord server, or any other part of our Services.
Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
6. Intellectual Property
The Website, its content, features, and functionality (including but not limited to all information, software, text, graphics, logos, and images) are owned by ScotEsports CIC (trading as Scottish Esports), its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of our Website without our prior written consent.
7. User-Generated Content
You may be able to post content, such as comments or profile information (“User Content”), on our Services. By posting User Content, you grant Scottish Esports a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content in connection with providing and promoting the Services. You are solely responsible for the User Content you post.
Third-Party Event Submissions
We may publish events submitted by third parties. By submitting an event, you confirm that the information you provide is accurate, lawful, and does not infringe the rights of others. You grant Scottish Esports a non-exclusive, royalty-free licence to display, reproduce, and promote the event details you provide.
We reserve the right to refuse, edit, or remove any event submission at our discretion. Event details may be retained as part of a permanent archive of Scottish esports activities. Personal contact details provided for submissions will not be published and will only be used for administrative purposes in connection with the submission. All submissions must also comply with our Code of Conduct (Section 5)
Scottish Esports is not a party to any contract between you and a third-party event organiser. We accept no responsibility for the organisation, safety, quality, or fulfilment of third-party events, including cancellations, postponements, or disputes relating to ticketing or attendance.
Scottish Esports may advertise third-party events on its website. We do not sell or process tickets for these events. Any registration, ticket purchase, or attendance arrangements are made directly with the event organiser. Scottish Esports is not responsible for ticketing, payments, refunds, or any issues arising from third-party events.
8. Termination
We reserve the right to suspend or terminate your account and access to the Services, at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms or our Code of Conduct. Upon termination, your right to use the Services will immediately cease.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall ScotEsports CIC (trading as Scottish Esports), its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Scotland, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Scotland.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. Your continued use of the Services after those revisions become effective constitutes your acceptance of the new Terms.
